Crime Watch
It is very sad that Francis Hartman a native of the Emmaus area but a former
Allentown resident killed himself... Many years ago when he lived in Allentown
he was  an associate of Emma Tropiano... Hartman was  member of a group
known as the Citizens Against the Historic Ordinance (CAHO) that fought the
special Historic districts such as Old Allentown and Old Fairgrounds then
being established in Downtown Allentown. And one of their early advocates  
which they promoted and helped be elected initially to Council was Emma
Tropiano... When Former Old Allentown President John Harry and CAHO
Advocate Emma Tropiano were on Council it was one of the best dramas in
Town ... When Historic District representatives were denied permission to do
work at their homes by the Historic Ordinance Hearing Board and appealed
to City Council, Tropiano always would vote against the wishes of the
Historical Ordinance Hearing Board or abstain from voting.  It is ironic that
when Hartman eventually  moved back to the East Penn School District area
that he became President of the Emmaus Historical Society ...
Proposed Bylaws for the The President's Council
of the Allentown Crime Watch
ALLENTOWN CRIME WATCH PRESIDENTS’ COUNCIL
BY-LAWS
      
I        PROGRAM PURPOSE
      The purpose of the Allentown Crime Watch Presidents’ Council shall be to
standardize procedures,         maintain quality and responsibility for the Crime
Watch program citywide.  Presidents’ Council will         also serve as a unified
(block) body with regard to major projects that would aid the Crime Watch
          program and any other Quality of Life issues (citywide).

II        MEMBERSHIP
      A.        PARTICIPATION        
      Membership shall consist of the President of each Crime Watch/Neighborhood
group
      that is within the legal city limits of Allentown, PA, recognized by the Allentown
      Police Department and/or the Allentown Police Department’s Crime Prevention
Officer.  
      Each individual President may elect to appoint a representative to attend
Presidents’ Council
      meetings in lieu of the President.  All members must hold a valid CHEC-MATE
card issued
      by the Allentown Police Department.  A copy of the Crime Watch/Neighborhood
groups’
      bylaws and any subsequent amendments shall be on file with the Advisor to
the Allentown                                 Crime Watch Presidents’ Council.  Each
authorized active member and inactive (as defined                                 below) will
be allowed to bring one (1) additional member from their organization.  
However,                                 only the authorized member will be allowed to speak
on the floor.  Associate members are
      not permitted to bring a guest to Presidents’ Council meetings.

B.        MEMBERSHIP CLASSIFICATION
      Active – An active member is the President (or appointed representative) of a
Crime Watch/
    Neighborhood group recognized by the Allentown Police Department that
distributes a
      flyer/newsletter that states their meeting date, time, and location and/or meets
at least
    (quarterly) two times per calendar year, attends at least five (5) Presidents’
Council meetings
    per calendar year, and has at least six (6) active members attending their group’
s meetings as
    verified by the Council President, Council Vice President, Council Advisor, or
the Allentown
    Crime Watch Coordinator.  
      A new Crime Watch/Neighborhood Group established mid-year (beyond June)
must meet the
    active membership criteria, however the President (or appointed
representative) must attend at
    least three (3) Presidents’ Council meetings for the remainder of that calendar
year.  

      Inactive – An inactive member is one whose recognized Crime
Watch/Neighborhood group                 ceased        meeting and/or distributes a
flyer/newsletter.  An inactive member can attend
      Presidents’ Council meetings for a period of one calendar year while
attempting to re-establish
      their crime watch group.  Inactive members may speak on the floor.  

      Associate – An associate member is one whose organization is viewed as
being involved
    in related activities that both Allentown Crime Watch and the associate member’
s group
      both benefit from.  The Presidents’ Council Executive Committee grants
associate member-
      ships.  Associate members may speak on the floor.

      Advisor – Allentown Police Department’s Crime Prevention Officer or designee
as determined
      by the Chief of Police. The Advisor is the final authority.  The Advisor is not
eligible to vote
    on Allentown Crime Watch business.  The Advisor will determine if a Crime
Watch/    
    Neighborhood group shall be represented in the Allentown Crime Watch
business.   The
   Advisor must visit member Crime Watch/Neighborhood groups at least annually.  

C.  VOTING
      The President (or a representative) of each Active recognized Crime Watch/
      Neighborhood is eligible to one vote on Presidents’ Council business and
Election of President
      Council Officers.  The President (or representative) of each Inactive
recognized Crime Watch/
    Neighborhood group is eligible to vote on Presidents’ Council business, but is
not eligible to
    Vote on Election of Presidents’ Council Officers, or hold an elected position on
the Board.
      
D.        DENIAL OF MEMBERSHIP
      Membership to the Allentown Crime Watch Presidents’ Council shall be
refused or
       terminated to any Crime Watch/Neighborhood group whose bylaws or actions
conflict with
      the Non-discrimination policy of the Allentown Crime Watch Presidents’
Council as stated
      in Section IX.  Membership would be refused or denied by majority vote of
quorum.

III        MEMBERSHIP MEETINGS
A.        REGULAR MEETINGS
      Meetings of the Allentown Crime Watch Presidents’ Council will take place on
the third
      Thursday of every month at a location that has been agreed upon by the
Executive Committee.  
      Meetings will start at 7:00 PM unless specifically changed.  The Leonard Buck
Banquet,
      which is held in lieu of the April meeting shall be, considered a regular
meeting for attendance
      purposes.

B.        SPECIAL MEETINGS
      Special meetings of the Allentown Crime Watch Presidents’ Council may only
be called by
      The Officers as deemed necessary.  Notification and purpose(s) of the special
meeting shall
    require forty-eight (48) hours advance written or telephone notice to all active
members of the
    Presidents’ Council.

C.        AGENDA
      The President shall prepare a written agenda for all regular and special
meetings of the
      Allentown Crime Watch Presidents’ Council.  Any member of Presidents’
Council may
      add an item to the agenda by submitting the item in writing to the President of
Presidents’
      Council at least seven (7) days in advance of the meeting.  The agenda shall
provide a
      general discussion period.  At the conclusion of regular business and prior to
the general
      discussion period any member of the Presidents’ Council may make a motion
to add an
      item to the agenda.  Adoption of that motion requires a second and vote by
quorum.

D.        QUORUM
      A quorum for any general or special meeting of the Allentown Crime Watch
Presidents’
      Council shall be the number of members in attendance.  Unless otherwise
specified in these
      bylaws, decisions of the Presidents’ Council shall be made by a majority vote
of those
      members (per paragraph II C) present at any meeting.            

E.        PROCEDURES
      The Allentown Crime Watch Presidents’ Council shall follow “Roberts Rules of
Order
      (Revised)” in all areas not covered by the bylaws.
    
    E-mail notification shall be considered as communication in the same manner as
mailed format.  

F.        FISCAL ACCOUNTABILITY
      The members of the Allentown Crime Watch Presidents’ Council must vote on
all matters
      in excess of twenty-five (25) dollars.  In cases of emergency distributions,
Executive
      Committee will be held accountable for their decisions.  The Allentown Police
Department
      Controls distributions of funds allocated by Allentown City Council.

G.        ALLENTOWN CRIME WATCH
    Under no circumstances is the name “Allentown Crime Watch” to be used for
contractual
      Agreements and /or stated at public meetings without prior support (by vote)
of the
      Presidents’ Council.  Those guilty of infractions to this rule can be subject to
dismissal from
      the Allentown Crime Watch Presidents’ Council by majority vote of quorum.

IV        COUNCIL OFFICERS
A.        TERMS OF OFFICE
      Each officer shall hold office for a term of (one (1) year) two years .  The term
of office shall
    be from January 1, 20xx even year through December 31, 20xx even year for
Presidents’
    Council President and Secretary and January 1, 20xx odd year through
December 31,
    20xx odd year for Presidents’ Council Vice President and Treasurer.    

B.        ELIGIBILITY
      Only Presidents of active (per paragraph II-B) Crime Watch/Neighborhood
groups shall be
      qualified to hold an elected position.  Any member of the Allentown Crime
Watch
      Presidents’ Council can hold appointed positions.

C.        ELECTION OF OFFICERS
      Nomination for officers will be held at the November meeting.  Election of
Presidents’
    Council President and Secretary will be held opposite election years of
Presidents’ Council
    Vice President and Treasurer.  Active members should be advised of the
people nominated
    prior to the December meeting.  (The people nominated and their position shall
be mailed to
    all members prior to the December meeting.)  At the December meeting a
motion shall be made
    and seconded for any additional nominees.  Voting shall occur by paper ballot
at the December
    meeting.  The President of the Allentown Crime Watch Presidents’ Council shall
vote last and
    only to break a tie.  This is only applicable for the election of officers.  A simple
majority of
    qualified members present is all that is required.  The results will be counted
and announced by
    the Crime Prevention Officer of the Allentown Police Department or its’
designee.  Under no
    Circumstances shall absentee ballots be permitted.  Elected officers take office
January 1.   

D.        DUTIES OF OFFICERS
      President-The President shall prepare an agenda and preside at all meetings
of the Allentown
      Crime Watch Presidents’ Council.  He/she shall appoint members to fill
committee positions
      and/or vacant officer positions not filled by election.  He/she will act as the
spokesperson for
      the Allentown Crime Watch Presidents’ Council or appoints someone to act on
his/her behalf.
      The President shall visit member Crime Watch/Neighborhood groups at least
annually.

      Vice President-The Vice President shall preside over the meetings in the
absence of the
       President and will assist the President in the operation of the Allentown Crime
Watch
      Presidents’ Council.  The Vice President shall visit member Crime
Watch/Neighborhood
      groups at least annually.

      Secretary-The Secretary shall keep minutes and written records of majority
and minority
      opinions expressed at all meetings; shall be responsible for all
correspondence of the
      Allentown Crime Watch Presidents’ Council; shall make records of the
Allentown Crime
      Watch Presidents’ Council available for inspection by the Allentown Crime
Prevention
      Officer, Allentown Police Chief (or designated Assistant Chief), President of
Allentown
      City Council, and/or the Mayor of the City of Allentown for any purpose at any
reasonable
      time.

      Treasurer-The Treasurer shall open and maintain a bank account(s) for the
Allentown
      Crime Watch Presidents’ Council.  Such account(s) shall require the signature
of the
      Treasurer and one other Officer, either the Council President or Vice
President, to withdraw
      money from the account.  The treasurer shall be responsible for all monies, for
keeping proper
      records and accounting for all monies, for reporting to the Allentown Crime
Watch Presidents’
      Council, and shall become bonded if bonding becomes required.  If bonding
becomes required
      The cost of bonding shall be borne by the Allentown Crime Watch Presidents’
Council.  The
      Treasurer shall be responsible for the preparation of semi-annual and annual
reports, and
      an annual audit that shall occur every December or when a change in the
Treasurer position
      occurs prior to the expiration of term.  (The Treasurer shall make the financial
records of the
      Allentown Crime Watch Presidents’ Council available for inspection by the
Allentown Crime
      Prevention Officer, Allentown Police Chief (or designated Assistant Chief),
President of
      Allentown City Council, and/or the Mayor of the City of Allentown (for any
purpose at any
      reasonable time.) Allentown Crime Watch Crime Prevention Officer, Allentown
Police
   Chief (or designated Assistant Chief), President of Allentown City Council and/or
the
   Mayor of the City of Allentown may request in writing with seven (7) days notice
the
   Treasurer submit the financial records for inspection .   

      If active members of Presidents’ Council determine that an officer is not
performing the
    duties of their position as defined by the Presidents’ Council By-laws active
Presidents’
    Council members shall vote to terminate that individual for his or her position
as Officer.
    Vote shall pass based on 2/3 majority vote of quorum.  

E.        FILLING AN OFFICE MID-TERM
      President-If the President should resign or unable to complete his/her term,
the Vice-President
      shall accede to the Presidency until the next regularly scheduled election.  No
vote is required.

      Vice President-If the Vice President should resign or unable to complete
his/her term, the
      President shall select a member of Allentown Crime Watch Presidents Council
that meets all
      of the criteria for Vice President as set forth in the by laws.  The person
selected is then         approved by quorum.
      
      Treasurer-If the Treasurer should resign or unable to complete his/her term,
the President
      shall select a member of Allentown Crime Watch Presidents’ Council that
meets all of the
      criteria for Treasurer as set forth in by laws.  The person selected is then
approved by
      quorum.

      Secretary-If the Secretary should resign or unable to complete his/her term,
the President
      shall select a member of the Allentown Crime Watch Presidents’ Council that
meets all
      of the criteria for Secretary as set forth in the by laws.  The person selected is
then approved
      by quorum.

V        COMMITTEES
A.        FORMATION OF COMMITTEES
      The President of the Allentown Crime Watch Presidents’ Council shall
establish both standing
      and ad hoc committees, as he/she deems necessary.  A standing committee
shall be one that
      operates continually.  An ad hoc committee is one that is formed for a specific
event or
      circumstance and then disbanded.  With the exception of the Executive
Committee, the
      Council President shall select all committee members from volunteers.  
Committees shall make
      recommendations to the Council for Council actions.  Committees shall not
have power to act
      on the behalf of the Allentown Crime Watch Presidents’ Council without
specific written
      authorization.

B.         PURPOSE
When a committee is formed, the purpose of that committee shall be stated in the
meeting
minutes.  This statement serves as the committee mission statement.

C.        COMMITTEE CHAIRPERSON
When the committee is formed, one of the members shall be designated
Committee Chairperson
by the Council President.  The duties of Committee Chairpersons are to call and
hold committee
meetings, provide a detailed report at each month’s Council meeting on the
progress and/or
activities of the committee for the month, and report any recommendation from the
committee to
the Council for Council action.

D.        EXECUTIVE COMMITTEE
The President, Vice-President, Secretary, Treasurer, and the Allentown Police
Department Crime
Prevention Officer shall comprise the five members of the Allentown Crime Watch
Executive
Committee.  The Executive Committee shall be authorized to deal with matters of
urgency.  The
Executive Committee is liable for their decisions at the general membership
meetings.  Council
President shall perform all of the functions of a Committee Chairperson for the
Executive
Committee.  Each member of the Executive Committee shall have one vote on the
committee.




VI        CONFLICT OF INTEREST
      A.        DEFINITION
      A conflict of interest exists for a member or officer whenever the member or
officer holds a personal financial interest, which will be impacted by the action or
inaction of
                      the Allentown Crime Watch Presidents’ Council on a proposal before
the membership.  
                      A conflict of interest exists if an officer is elected to a position within
the City of Allentown (Mayor, City Council, Controller).  A personal financial interest
shall include a financial interest held by a member or officer and/or members of
their immediate family.  A personal financial includes any ownership interest of a
business, which will be impacted by a decision of the Allentown Crime Watch
Presidents’ Council.

      B.        DECLARING THE CONFLICT OF INTEREST
      Whenever a member or officer determines that they have a conflict of interest
relating to an item under discussion, they must inform the body hearing the
proposal that the conflict of interest exists.

      C.        ABSTENTION
      Members or officers having declared a conflict of interest shall not participate
in any discussion nor shall they vote on any subject that they have declared the
conflict of interest.  Any member or officer who does not declare a conflict of
interest where it has been discovered a conflict occurred shall be subject to
disciplinary action as determined by the Executive Committee up to and including
dismissal from the Allentown Crime Watch Presidents’ Council.

      D.        VACATE OFFICE
      Members or officers shall vacate the office they hold upon being elected to a
position within the City of Allentown.  Any member or officer running for an elected
position in the City of Allentown shall not use the Allentown Crime Watch
Presidents’ Council as a platform for the election.

VII        PROCEDURE FOR CONSIDERATION OF PROPOSALS
      A.        SUBMISSION OF PROPOSAL
      Any person or group, outside the boundaries of the Allentown Crime Watch
Presidents’ Council and any City agency may propose in writing items for
consideration and/or recommendation to any member of the Executive Committee
of the Allentown Crime Watch Presidents’ Council.  The Executive Committee shall
recommend at the next general meeting if the proposal should be referred to a
committee or appear on the following month’s regular meeting agenda.

      B.        NOTIFICATION
      The proponent and members directly affected by the submitted proposal shall
be notified in writing of the place, day, and time the proposal will be reviewed not
less than seven (7) days in advance.

      

C.        ATTENDANCE
      The proponent is expected to attend this meeting to make a presentation and
answer questions concerning the proposal.

      D.        DISSEMINATION
      The Allentown Crime Watch Presidents’ Council shall submit recommendations
and dissenting views as recorded from the meeting to the proponent and other
appropriate parties.

VIII        GRIEVANCE PROCEDURES
      A.        ELIGIBILITY TO GRIEVE
      A person or group adversely affected by a decision or policy of the Allentown
Crime Watch Presidents’ Council may submit in writing a complaint to any member
of the Grievance Committee.

      B.        GRIEVANCE COMMITTEE
      Grievance Committee shall be a standing committee consisting of three (3)
members and two (2) alternates appointed by the President of the Allentown Crime
Watch Presidents’ Council.  No member of the Executive Committee shall be a
member of the Grievance Committee.  The alternates shall be used when a regular
committee member is involved in a filed grievance.

      C.        COMPLAINT RECEIPT
      Within seven (7) days of receipt of the complaint, the Grievance Committee
shall arrange a mutually acceptable place, day, and time to meet with the petitioner
to review the complaint.  The President of the Allentown Crime Watch Presidents’
Council shall also be informed that a complaint has been received and that a
Grievance Committee report be added to the agenda of the next regular meeting
of the Allentown Crime Watch Presidents’ Council.

      D.        RESOLUTION PROCEDURE
      The Grievance Committee shall attempt to resolve the complaint by
recommending a resolution of the grievance in writing within thirty (30) days of the
meeting with the petitioner to both the Allentown Crime Watch Presidents’ Council
and the petitioner.  If the Grievance Committee and the petitioner cannot reach an
agreement, the Advisor to the Allentown Crime Watch Presidents’ Council shall
review all of the facts presented and make his/her recommendation to the
Allentown Crime Watch Presidents’ Council.  Final resolution shall be by simple
majority vote of all eligible members present on the recommendation forwarded to
the Council for vote.  President of the Council is authorized to call a special
meeting to resolve this type of dispute.

IX        NON-DISCRIMINATION POLICY         
      The Allentown Crime Watch Presidents’ Council must not discriminate against
individuals or
          groups on the basis of race, religion, color, sex, age, disability, national
origin, sexual
          orientation, income, or political affiliation in any of its policies,
recommendations, or actions.
      Because the Allentown Crime Watch Presidents’ Council is comprised of
representatives of
          many Crime Watch/Neighborhood groups the Non-discrimination policy of
the Allentown Crime
          Watch Presidents’ Council must be present as stated in the by-laws of all
member Crime Watch/
          Neighborhood groups.  
      
X        PUBLIC MEETINGS/PUBLIC RECORDS REQUIREMENTS
      The Allentown Crime Watch Presidents’ Council shall abide by all Pennsylvania
statutes relative to public meetings and public records.  Official action(s) taken by
the Allentown Crime Watch Presidents’ Council must be on record or part of the
minutes of each meeting.  The minutes shall include a record of attendance and
the results of any vote(s) taken.  A summary of dissenting views shall also be
included with any recommendation made by the Allentown Crime Watch
Presidents’ Council.
XI        ADOPTION AND AMMENDMENTS OF BYLAWS
      A.        POLICY
      (All amendments to these bylaws must be proposed by in writing and
submitted to the Allentown Crime Watch Presidents’ Council Executive Committee
at least fourteen (14) days before voting on them may proceed.  The Executive
Committee may refer the amendment proposal to the Bylaw Committee for review
and recommendation.  Notice
                      of proposal to amend the bylaws, specifying the proposed
amendment, date, time, and place for consideration, must be provided to all
members of the Allentown Crime Presidents’ Council at least seven (7) days
before the vote is to occur.)

              All amendments to these bylaws must be proposed by verbal motion at a
defined
                      Allentown Crime Watch Presidents’ Council meeting or in writing  to
Allentown
                      Crime Watch Presidents’ Council Executive Committee.  If the motion
to consider
                      the bylaw amendment is approved by Allentown Crime Watch
Presidents’ Council
                      by majority vote of quorum the Executive Committee may forward the
proposal to
                      the Bylaw Committee for review.  The Bylaw Committee will review
the proposal
                      and submit recommendations.  
                      Active Members of the Allentown Crime Watch Presidents’ Council
shall be
                      notified at least seven (7) days before the vote to amend the bylaws
is to occur.   
                      
      B.        ADOPTION
      Adoption of and amendments to these bylaws shall require a two-thirds (2/3)
majority vote by quorum.
